AN ACT TO AMEND SECTION 29-15-13, MISSISSIPPI CODE OF 1972, TO EXEMPT FROM STATE USE OR RENTAL FEES CHARGED FOR PUBLIC TRUST TIDELANDS THOSE LANDS LOCATED ON ANY MILITARY ESTABLISHMENT ADJACENT TO EXEMPTED GOVERNMENT PUBLIC PROJECTS; TO PROVIDE THAT THE ISSUANCE OF A WETLANDS PERMIT FROM THE DEPARTMENT OF MARINE RESOURCES CONSTITUTES NOTIFICATION TO THE SECRETARY OF STATE OF EXEMPTIONS FROM USE OR RENTAL FEES; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. Section 29-15-13, Mississippi Code of 1972, is amended as follows:
29-15-13. All public projects of any federal, state or local governmental entity which serve a higher public purpose of promoting the conservation, reclamation, preservation of the tidelands and submerged lands, public use for fishing, recreation or navigation, or the enhancement of public access to such lands, or any military establishment adjacent to such lands, shall be exempt from any use or rental fees. The issuance of a wetlands permit from the Department of Marine Resources shall constitute notification and application to the Secretary of State for an exemption under this section.
SECTION 2. This act shall take effect and be in force from and after its passage.
